TERMS OF SERVICE

1.1 Account Creation

To use MatchSport, you must complete mandatory basic verification:

• Provide truthful information (full name, valid email, date of birth).
• Complete age verification through date-of-birth selector (under-18 rejected).
• Upload at least one profile photo that complies with Community Guidelines.
• Complete mandatory photo verification via selfie with anti-deepfake AI (Veriff or other EU provider).
• Verify account via OTP code sent by email or SMS.
• Expressly accept these Terms and the Privacy Policy via checkbox.

Optional Premium Verification adds a visible "Verified" badge, increases match rate and trust, and is fully voluntary.

1.2 Identity Verification

Profile photo + verification selfie use AI matching with 95% accuracy in fake-profile detection. Biometric data is processed exclusively for verification and deleted immediately after (GDPR Art. 9 compliance).

2.1 Account Security

• Maintain the confidentiality of your password.
• You are responsible for all activity under your account.
• Notify support@matchsport.org immediately of any unauthorized access.
• Do not share credentials. Log out on shared devices.

2.2 Account Suspension and Termination

MatchSport may suspend or terminate accounts without prior notice for violations of these Terms, fraudulent activity, multiple reports, underage users, or unmet payment obligations.

Appeals: Email support@matchsport.org with subject "Suspension Appeal". Response within 48 business hours.

3.1 License of Use

MatchSport grants a limited, non-exclusive, non-transferable, revocable license to use the app on your iOS or Android device, create a personal profile, swipe, match, and chat. Reverse engineering, scraping, bots, multiple accounts, and resale are prohibited.

3.2 Matching System and Swipes

The algorithm connects users based on gender preference, age range (±5 years), proximity (50 km), and at least one shared sport from 18+ activities.

• Swipe right / Like — interest in a profile.
• Swipe left / Pass — dismiss (no notification sent).
• Swipe up / Super Like — special interest (premium: 5/day).
• Mutual match unlocks chat.

Free limits: 10 likes/day (resets 00:00 CET), 0 super likes, no "who liked you", basic filters only.

3.3 Chat and Messaging

Chat is available only between mutual matches. Messages are stored in real-time on Firebase Firestore (EU region), encrypted in transit and at rest. Reported messages may be reviewed for security investigations.

4.1 Plans and Pricing

Premium Plan: $9.99 USD/month (VAT included for users in Spain). Payments processed by Stripe, Inc. (PCI-DSS Level 1). MatchSport does NOT store credit card data. Subscriptions renew automatically until canceled.

4.3 Right of Withdrawal, Cancellation and Refunds (EU Consumers)

Under Articles 102–108 of the Spanish General Law for the Defence of Consumers and Users (TRLGDCU) and Directive 2011/83/EU, EU consumers have the right to withdraw from a Premium subscription within fourteen (14) calendar days from the date the contract is concluded, without giving any reason and without penalty. To exercise this right, send a clear statement to support@matchsport.org; you may use the model withdrawal form provided in Annex B of TRLGDCU.

If you start using the Premium service (for example, by sending a Super Like, unlocking "who liked you" or using Play Now) before the 14-day period expires, you expressly request immediate performance and acknowledge that you will lose the right of withdrawal once the service has been fully performed, in accordance with Art. 103.m TRLGDCU. If you withdraw during the 14-day window before fully consuming the service, you will be charged only the proportional amount corresponding to the part of the service already provided.

Outside the withdrawal period, you can cancel auto-renewal at any time in Settings → Subscription. Access continues until the end of the current billing period. Refunds for technical errors, duplicate charges, accidental purchases or service failures can be requested at support@matchsport.org and will be processed using the same payment method within fourteen (14) days. These rights are without prejudice to the statutory two-year legal guarantee of conformity (Arts. 114–127 TRLGDCU).

5.1 Prohibited Conduct

• Harassment, threats, stalking, or discrimination.
• Unsolicited explicit sexual content or nudes.
• Fake profiles, catfishing, or false identities.
• Spam, commercial promotion, or pyramid schemes.
• Romance scams or money requests.
• Bots, scripts, scraping, or automation.
• Illegal content (CSAM, hate speech, drug trafficking).
• Sharing other users' personal data without consent.
• Multiple accounts to evade bans.

5.2 Content Moderation

Automated AI moderation detects prohibited content. Reports are investigated within 24 hours; 3+ independent reports trigger automatic action.

5.3 Reporting System

When you report a user, they are blocked automatically. The team reviews evidence and takes action within 48 hours.

6.1 MatchSport Ownership

All IP rights over the MatchSport application are the exclusive property of Olvexis Group, protected under Spanish and EU law: trade name, logo, source code (Flutter/Firebase), matching algorithm, UI/UX, and visual elements.

6.2 User-Generated Content

You retain ownership of content you upload. By uploading, you grant MatchSport a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to display, store, process, moderate, and use anonymized content for service improvements.

6.3 Copyright Infringement (DMCA)

Send DMCA notices to support@matchsport.org with subject "DMCA Takedown Request" including identification of the work, location of infringement, your contact details, sworn statement, and signature. Response within 48 business hours.

7.1 Service "AS IS"

MatchSport is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including merchantability, fitness for purpose, uninterrupted availability, or that you will find a partner.

7.2 Exclusion of Liability

MatchSport is NOT responsible for the behavior of other users, offensive or illegal user content, physical/emotional/financial damages from interactions, data loss, scams, or service interruptions.

7.3 Damages Limit

For users acting as consumers in the European Union, nothing in these Terms limits or excludes MatchSport's liability for fraud, wilful misconduct, gross negligence, personal injury, death, or any other liability that cannot be excluded under mandatory consumer protection law (in particular Arts. 82–90 and 147 TRLGDCU). Outside those cases, and to the maximum extent permitted by applicable law, MatchSport's aggregate liability for direct damages arising from the Premium subscription is limited to the amount actually paid by the user during the twelve (12) months preceding the event giving rise to the claim. Indirect or consequential losses unrelated to the service are excluded only where such exclusion is permitted by law.

7.4 Safety Warnings

Verify identity before sharing personal info, meet in public places, inform trusted persons of your plans, never share financial information, and report suspicious behavior.

These Terms are governed by Spanish law. For users acting as consumers, this choice of law does not deprive you of the protection of mandatory rules of the law of the country where you have your habitual residence (Art. 6 Rome I Regulation).

Jurisdiction for consumers: in accordance with Articles 17–19 of the Brussels I bis Regulation (EU 1215/2012), consumer users may bring proceedings against MatchSport either before the courts of Madrid (Spain) or before the courts of the EU Member State where the consumer is domiciled. MatchSport may only sue a consumer before the courts of the consumer's domicile. For users not acting as consumers, the courts of Madrid have exclusive jurisdiction.

Out-of-court resolution: before initiating court proceedings, we encourage you to contact support@matchsport.org so we can try to resolve the issue amicably. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr and lodge a complaint with the consumer authorities of their place of residence or with the Dirección General de Consumo of the Community of Madrid.

Arbitration: arbitration is entirely voluntary for consumers and only applies if both parties specifically agree in writing after the dispute has arisen. No clause of these Terms forces consumers to waive class actions or collective redress rights granted by Directive (EU) 2020/1828.

In compliance with Regulation (EU) 2022/2065 (Digital Services Act), MatchSport designates the following single point of contact for authorities and recipients of the service: support@matchsport.org. Notices may be submitted in Spanish or English.

Notice and action: any user or third party may notify allegedly illegal content via support@matchsport.org or via the in-app "Report" button. Notifications must identify the content, its location, the reasons it is considered illegal, and the contact details of the notifier. We acknowledge receipt, take a decision without undue delay and inform both the notifier and the affected user of the decision and the available redress mechanisms, including internal complaint handling, out-of-court dispute settlement bodies and judicial remedies.

Transparency: MatchSport publishes an annual transparency report covering moderation actions, orders received from Member State authorities and the average monthly active recipients of the service in the Union, in accordance with Arts. 15 and 24 DSA.

9.1 Termination by User

Settings → Account → Close Account. Profile becomes invisible; data deleted within 30 days (except payment records). No refund for remaining premium period.

9.2 Termination by MatchSport

Immediate termination for Terms violations, fraud, multiple reports, underage users, or unpaid obligations. No refund for terminations due to violations.

9.3 Survival of Clauses

Sections 4 (pending payments), 6 (IP), 7 (Liability), and 8 (Law & Disputes) survive termination.

These Terms, together with the Privacy Policy, the Cookie Policy and the Legal Notice, constitute the complete agreement between you and MatchSport. Invalid or unenforceable provisions are severed and replaced by valid provisions that best preserve the original intent; the remaining provisions stay in force. MatchSport may assign these Terms in case of merger, acquisition or sale of assets, provided the assignee assumes the same obligations; users may not assign their rights and obligations without prior written consent.

A Spanish-language version of these Terms is available on request at support@matchsport.org. For users domiciled in Spain, the Spanish version prevails in case of discrepancy.

By creating an account on MatchSport, you certify that you have read and understood these Terms, you are at least 18, you agree to be legally bound, you accept the Privacy Policy, and you may cancel at any time. A checkbox during registration is required.
